Welcome to Canterbury Weather Updates Membership Service, an online weather service, for commercial and personal use. These Terms of Use are intended to explain our obligations as a service provider and Your obligations as a customer. Please read them carefully.
These Terms are binding on any use of the rervice and apply to You from the time that Canterbury Weather Updates provides you with access to the Service.
By registering to use the rervice you acknowledge that you have read and understood these Terms and have the authority to act on behalf of any person for whom You are using the Service. You are deemed to have agreed to these Terms on behalf of any entity for whom you use the Service.
Legal Disclaimer
The forecasts & information provided on the membership service are provided with the awareness that weather is not an exact science and due to this there is always a degree of uncertainty. However, Canterbury Weather Updates sets high prioritisation on providing up to date, accurate forecasts & information.
Due to a degree of unpredictability in the weather, you as the user & member understand that our forecasts are an educated opinion and therefore 100% accuracy is not guaranteed.
Canterbury Weather Updates holds no responsibility for events that cause damage, loss of money or other compensation from the content within the website.
You acknowledge that the forecasts and information supplied are a "guide" and the information provided is simply the opinion of Canterbury Weather Updates. As the user of this information you agree that there are no guarantees or warranties in relation to our forecasts including accuracy and timeliness.
Payment: Payment is provided through a secure payment check out process with https://stripe.com/nz . Stripe is a secure payment provider and is now a world leader in online payments. All subscription prices are in New Zealand dollars. Once initial payment has gone through you will be given access to our service, the next payment will be on the same day next month or time period of your membership level. It's a recurring monthly payment, you don't need to do anything. You can cancel at any time.
Renewing your subscription: Your subscription will not expire and will renew automatically into the next subscription period. This means we will continue to provide and charge you for our service until you cancel. You can cancel through the website or email the CWU Team.
Cancellation: You have the right to cancel your subscription at any one time; on your membership profile .This will stop the payment occurring at any of the selected payment levels. If you cancel your membership before the end of it’s period, you will not be refunded.
Fees and Payments
Subscriptions: Our service is billed on a subscription basis (we call these “Subscriptions”). This means that you will be billed in advance on a recurring, periodic basis (each period is called a “billing cycle”). Billing cycles are typically weekly, monthly or annual, depending on what subscription plan you select when purchasing a Subscription. Your Subscription will automatically renew at the end of each billing cycle unless you cancel auto-renewal through your online account management page, or by contacting our customer support team. While we will be sad to see you go, you -renewal on your Subscription at any time.
1.2 Price Changes: Canterbury Weather Updates may change the fees charged for the Services at any time, provided that, for Services billed on a subscription basis, the change will become effective only at the end of the then-current billing cycle of your Subscription. Canterbury Weather Updates will provide you with reasonable prior written ( at least 2 months) notice of any change in fees to give you an opportunity to cancel your Subscription before the change becomes effective.
Operating functionality of the Q/A forum (GOLD & PREMIUM MEMBERS ONLY)
Canterbury Weather Updates will do it’s to ensure all questions are answered during operating times Monday 6am to Friday 5pm. During forum operating hours, this will be within 24 hours. We can’t guarantee all questions will be answered, due to the potential for significant traffic or technical difficulties.
The forum doesn’t just provide an avenue to ask questions, but also a place to source out information. If possible, please remember to check that your question hasn’t already been asked.
- Operating hours: 6am Monday to 5pm Friday.
- Questions stated after the operating hours will be answered on the Monday.
- You will be notified via email, when your questions have been answered. Please note, this may go to your ‘Trash’ folder.
Suspension and Termination of Services
If you terminate a Subscription in the middle of a billing cycle, you will not receive a refund for any period of time you did not use in that billing cycle unless you are terminating these Terms for any of the following reasons: (a) we have materially breached these Terms and failed to cure that breach within 30 days after you have so notified us in writing; or (b) a refund is required by law.
Termination
Only an individual may be a Canterbury Weather Updates member. You must not register as a member multiple times. You must not impersonate or create a membership for any person other than yourself.
You must keep your password safe and must not disclose it to any other person nor should you keep a written or electronic record of your password. You are wholly responsible for all activities which occur through use of your CWU Account. You must not permit your log in details to be used by or transferred to any other person. Providing your log in details to another person, will result in termination of membership.
You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of New Zealand, your country or International Law. Doing so may lead to you being immediately and permanently banned. You agree that “Canterbury Weather Updates” have the right to remove you as a member before your membership has finished. We also may edit, move or close any topic at any time should we see fit.
Right to Use Website & Content
You may access, view and print the content on this forum & site and our forum for informational and non-commercial purposes. No part of this website & forum may be distributed or copied for any commercial purpose.
Canterbury Weather Updates reserves the right to alter, suspend or terminate this site temporarily or permanently at any time or to deny access to this site without notice.
